Ignoring the "longtime member" stipulation for a moment, 1. Outside of the FCCs band limits, there are no legal considerations. All band plan compliance is voluntary. The FCC will act if anyone is obviously obstructing communications, band plan or not. 2. The primary voluntary band plans are from the ARRL for the US, and in this specific area the NARRC. ( http://www.narcc.org/ ) 3. The SARES repeater frequency, offset, and PL is coordinated by the NARRC. 4. The SARES simplex frequencies are in the NARRC set of recommended 2-Meter frequencies (15KHz separations). The FCC's recommended policy is that if someone is on your regular net frequency, you should move over a few KHz and operate from there. (You can ask them to move.) This is exactly what Mt View had to do 3 weeks back on the SPECs Net. The offset would normally be ~15KHz for 2-meter FM. The Mt. View situation was disturbing because they did not hear a call sign and they could not break on to the channel to contact the operators. This needs to be probed a bit more. We could be next and this could be a serious problem in an emergency.
