ALL,
After reading the ARRL info on the California Hands Free law, I
checked the CHP - FAQs and could not find a definitive answer.
Therefore the question was posed to the person named on the FAQs, turned
out to be the Commander, Office of Media Relations, California Highway
Patrol.
The Commander's reply is directly below (Original Message). Perhaps
we should clip the reply to keep with our Registration & Insurance / Go Kit.

Hi Robert,

The new laws refer only to wireless telephones. If you're using a
wireless telephone, then the laws would apply. I would be remiss if I
didn't urge you to drive carefully while operating your amateur radio,
but amateur radios are not covered by the new laws, unless they are also
wireless telephones.

I hope this clears up any confusion or concern. If you have any other
questions, please feel free to ask.

Thanks!

Fran,
As the Emergency Coordinator of the Sunnyvale Amateur Radio
Emergency Service (SARES), supporting the city of Sunnyvale Department

of Public Safety - Office of Emergency Service, I have a question. As
a
FCC licensed Amateur Radio Operator, how is the operation of a vehicle

mounted, licensed Amateur Radio station - while driving, effected by
the
'Cell phone hands free law'? The confusion and concern is because this

is an Amateur Radio Transceiver and not a mobile telephone.
I will be meeting with SARES membership next week and would like to

provide accurate information.

Thank You
Robert Gundrum, W6MOL
Sunnyvale Amateur Radio Emergency Service
